These Terms of Service (“Terms”) govern your access to and use of pornchar.ai (the “Service”), operated by pornchar.ai (“we”, “us”, “our”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility — 18+ only
The Service contains adult, sexually explicit material and is strictly for adults. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service you represent and warrant that you meet this requirement and that it is lawful for you to view adult content where you are located.
2. The Service
The Service provides interactive AI-generated characters, chat, and AI-generated images and videos. All characters are fictional. All content is computer-generated and does not depict real, identifiable people. Outputs are generated by automated systems and may be inaccurate, repetitive, or unexpected.
3. Accounts
You are responsible for your account and for keeping your credentials secure. You must provide accurate information and may not impersonate others or share your account. We may suspend or terminate accounts that violate these Terms.
4. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms. In particular, you may not use the Service to create, request, or distribute content involving minors, real identifiable people without consent, non-consensual acts, or any illegal content.
5. Credits and payments
Certain features require credits, purchased through our payment providers. Prices are shown at checkout. Credits are a limited license to use Service features, have no cash value, and are non-transferable. Purchases are subject to our Refund Policy.
6. User content and licence
You retain ownership of content you create or upload, subject to the rights of the Service. You grant us a worldwide, non-exclusive licence to host, store, process, and display your content solely to operate and improve the Service. You are responsible for ensuring you hold all rights necessary to any reference material you upload.
7. Intellectual property
The Service, including its software, design, and branding, is owned by the operator and protected by law. We grant you a limited, revocable, non-exclusive licence to use the Service for personal, non-commercial purposes in accordance with these Terms.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. AI-generated content is fictional and provided for entertainment; it is not advice of any kind.
9. Limitation of liability
To the maximum extent permitted by law, the operator will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Service. Our aggregate liability is limited to the amount you paid us in the three months before the claim.
10. Termination
We may suspend or terminate your access at any time for violation of these Terms or the Acceptable Use Policy. You may stop using the Service and delete your account at any time from your account settings.
11. Governing law
These Terms are governed by the jurisdiction in which the operator is established, without regard to conflict-of-laws rules.
12. Changes
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes take effect constitutes acceptance.
